These Terms of Service ("Terms") govern your use of the Nistabli platform at nistabli.com(the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Description of Service
Nistabliprovides an AI-powered WhatsApp customer service platform. Business owners subscribe to the Service, provide information about their business, connect their WhatsApp Business number, and the Service uses artificial intelligence to automatically respond to their customers' WhatsApp messages.
The Service includes: AI-powered message classification and response generation, order management, customer service team coordination, usage analytics, and multi-language support.
2. Account Registration
To use the Service, you must:
- Sign in using a Google (Gmail) account. We do not support other authentication methods.
- Provide accurate business information during onboarding.
- Be at least 18 years of age.
- Have the legal authority to bind your business to these Terms.
- Accept these Terms and our Privacy Policy before selecting a plan.
You are responsible for maintaining the security of your Google account. We are not liable for unauthorized access resulting from your failure to secure your credentials.
Each person may maintain only one account. Creating multiple accounts to circumvent plan limits or abuse the Free plan is prohibited and will result in account termination.
3. Subscription Plans and Billing
We offer five subscription plans: Free, Starter, Pro, Agency, and Enterprise. Current pricing and feature details are displayed on our pricing page at nistabli.com/#pricing.
Payment processing is handled by Paddle.com, which acts as our Merchant of Record. When you subscribe to a paid plan:
- Paddle processes your payment and handles applicable taxes.
- Subscriptions renew automatically at the end of each billing period.
- You may upgrade your plan at any time. Upgrades take effect immediately with prorated billing.
- You may downgrade your plan at any time. Downgrades take effect at the start of your next billing period, not immediately.
- You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access until then.
Free plan: Limited to 100 messages (lifetime total, not monthly). Free plan accounts are automatically deleted after 30 days of inactivity.

4. Acceptable Use
You agree to use the Service only for lawful business purposes. You may:
- Set up AI-powered customer service for your legitimate business.
- Configure products, pricing, and business information accurately.
- Use the customer service tools to manage customer conversations.
- Invite team members to help manage your business on the platform.
5. Prohibited Use
You must NOT:
- Send unsolicited messages (spam) through WhatsApp. All conversations must be initiated by the customer.
- Provide false or misleading business information.
- Use the Service to sell illegal products or services.
- Use the AI to generate harmful, abusive, discriminatory, or illegal content.
- Attempt to circumvent plan limits, rate limits, or usage restrictions.
- Create multiple accounts to exploit the Free plan.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use the Service to collect or harvest personal data for purposes not related to customer service.
- Interfere with or disrupt the Service or its infrastructure.
- Violate WhatsApp's Business Policy, Commerce Policy, or Terms of Service.
Violation of these rules may result in immediate account suspension or termination without refund.
6. AI Disclaimer
The Service uses artificial intelligence (AI) to classify customer messages and generate responses. You acknowledge and agree that:
- AI-generated responses may contain errors or inaccuracies.
- You are responsible for the accuracy of the business information that the AI uses to generate responses (products, prices, policies).
- You should review your AI behavior settings regularly to ensure responses meet your standards.
- We do not guarantee that AI responses will be appropriate for every situation.
- We are not liable for damages resulting from incorrect AI-generated responses.
- The AI does not provide medical, legal, or financial advice.
The AI is designed to escalate complex situations to human agents. You are responsible for staffing your customer service team appropriately, especially for plans that include dashboard customer service chat.
7. WhatsApp Messaging Rules
By connecting your WhatsApp Business number to the Service, you agree to:
- Comply with WhatsApp's Business Policy and Commerce Policy.
- Only respond to conversations initiated by your customers (no unsolicited outbound messaging).
- Ensure your WhatsApp Business profile accurately represents your business.
- Not use the Service to send promotional spam or bulk messages.
We reserve the right to disconnect your WhatsApp integration if we detect policy violations.
8. Data Ownership
- Your data: You retain ownership of all business information, customer data, and conversation content that you or your customers create through the Service. We do not claim ownership of your data.
- Our license: By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service (including AI processing, message delivery, and analytics).
- Upon termination: When you delete your account, your data is anonymized in accordance with our Data Deletion Policy. Certain records may be retained in anonymized form for financial compliance.
9. Intellectual Property
The Service, including its design, code, AI models integration, and documentation, is owned by Nistabli and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service.
10. Account Suspension and Termination
We may suspend or terminate your account if:
- You violate these Terms or any applicable law.
- You violate WhatsApp's policies, resulting in risk to our platform.
- Your payment fails and is not resolved within the grace period.
- We detect fraudulent or abusive activity.
You may terminate your account at any time through your account settings or by contacting us at support@nistabli.com.
11. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind.
- We do not guarantee uninterrupted or error-free service.
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.
- We are not liable for actions taken by WhatsApp, Google, Paddle, or AI providers that affect your use of the Service.
12. Governing Law
These Terms are governed by the laws of Morocco. Any disputes will be resolved in the courts of Morocco, unless otherwise required by applicable consumer protection laws.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes via email or through a notice on the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.
